1. Acceptance of Terms
By accessing or using Premium Audio's text-to-speech service, you agree to be bound by these Terms of Service and the laws of the Commonwealth of Kentucky, United States. You acknowledge that these terms shall be governed by and construed in accordance with Kentucky law, regardless of your location or the laws of your jurisdiction.
1.1 International Users
If you are accessing our service from outside the United States, you explicitly acknowledge and agree that:
- You are choosing to use a United States-based service
- Your data will be stored and processed in the United States
- You are subject to Kentucky law, not the laws of your location
- This includes waiving any rights or protections you may have under your local laws, including but not limited to the European Union's General Data Protection Regulation (GDPR) or similar international privacy and data protection laws
- Any disputes will be resolved exclusively in Warren County, Kentucky courts
- If these terms conflict with laws in your jurisdiction, you should not use this service
2. Service Description
Premium Audio provides professional text-to-speech conversion services using computer-generated voices. Features and limitations are described on our website. All audio files are delivered through secure, time-limited URLs that enhance privacy and security.
2.1 Service Quality and User Responsibilities
You acknowledge and understand that:
- Our service uses computer-generated voices which may occasionally have pronunciation issues
- The quality of the output depends significantly on the formatting and structure of your input text
- You are responsible for:
- Testing the service with samples before large-scale use
- Ensuring proper text formatting with correct punctuation
- Performing any necessary text normalization or pre-processing
- Reviewing generated audio for acceptability
- The service is provided "as is" and may not be perfect for all use cases
2.2 Security Features
We utilize presigned URLs for all audio file downloads, which provides several security benefits:
- File Retention: Your audio files are securely stored for 7 days
- Temporary Access: Each download link expires after a short time period
- Access Control: Only authorized users can access their audio files
- Secure Distribution: Files are served through encrypted connections
- Privacy Protection: Direct file access is prevented through unique, temporary URLs
2.3 Text Submission Guidelines
When submitting text for conversion:
- Maximum file size: 30MB of text (capable of generating up to 24 hours of audio)
- Maximum concurrent submissions: 10 per user
- Supported file formats: PDF, DOCX, DOC, TXT, CSV
- Text content is stored in our database for billing and account history purposes
- Bulk submissions must be processed through our API with appropriate rate limiting
2.4 Content Storage and Access
By using our service, you acknowledge and agree that:
- Your submitted text content will be stored in our database for billing and account history purposes
- You can access your conversion history and associated text content through your account
- Generated audio files are automatically deleted after 7 days
- You are responsible for downloading and backing up your audio files before they expire
- For large text submissions that generate lengthy audio files (up to 24 hours), ensure you have adequate bandwidth for downloading
3. Account Terms
You are responsible for maintaining the security of your account and payment information. We reserve the right to suspend or terminate accounts that violate these terms.
4. Acceptable Use
You agree not to use the service for:
- Any unlawful purposes under Kentucky law
- Harassment or abuse
- Spam or automated bulk operations without proper authorization
- Content that infringes on others' intellectual property rights
- Any purpose that could damage or impair the service
4.1 Content Moderation
We maintain the right to:
- Review submitted text content for policy violations
- Reject submissions that violate our acceptable use policy
- Suspend accounts that repeatedly submit violating content
- Remove generated audio files that violate our terms
- Report illegal content to appropriate authorities
5. Payment Terms
Paid features are available through pre-paid credits. Credits expire six months after purchase, with oldest credits being used first. We reserve the right to modify pricing with notice to users.
6. Intellectual Property Rights
You retain ownership of your input text content. You receive full commercial rights to use any audio generated through our service without attribution requirements. Generated audio files may be used for any legal purpose, including commercial use, without additional licensing fees.
7. Copyright and Content
You must have the necessary rights or permissions for any text you submit for conversion. Premium Audio respects intellectual property rights and will respond to notices of alleged copyright infringement.
8. Service Limitations
We strive for 99.9% uptime but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with notice to users. Processing times for large text submissions (approaching 24 hours of audio) may be longer than standard submissions.
9. Liability and Indemnification
The service is provided "as is" without warranties. Our liability for any damages arising from service use, interruption, or credit expiration is limited to the amounts you have paid to use the service.
You agree to indemnify and hold harmless Premium Audio, its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with:
- Your access to or use of the service
- Your violation of these Terms of Service
- Your violation of any third-party right, including without limitation any intellectual property right
- Any content you submit, post, or transmit through the service
- Any unlawful use of the service
10. Privacy and Data
Our collection and use of personal information is governed by our Privacy Policy.
11. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law provisions. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Warren County, Kentucky, United States. You agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims or disputes, regardless of your location or local laws.
12. Changes to Terms
We may modify these terms at any time. Continued use of the service constitutes acceptance of modified terms.
